The Conseil d’Etat, France’s supreme court in administrative matters, has rejected two appeals against Iberdrola’s 500 MW Saint-Brieuc wind farm off the north-west coast brought by an environmental group Gardez les caps and rival developer Nass & Wind. The cases centred on the irregularity in the tendering procedure held in 2012 and the operating licence for the project.

Despite concurring with the irregularity, the Council of State believes it does not have any impact on the project and has therefore rejected the appeals, but ordered a EUR2.5 million (US$2.8 million) compensation to Nass & Wind for the caused damage.

Additionally, the Council considers that the Gardez les caps organization is not authorized to submit the appeal as it is not directly related with the tender.

Iberdrola is the main shareholder in Ailes Marines, which is developing the project. Other companies in the consortium include Renewable Energy Systems (RES) and Caisse des Depots.
